A survivor’s benefit is a social security benefit designed to provide financial support to the dependents of a deceased insured individual under the Brazilian Social Security Institute (INSS).
For ex-partners, the right to receive survivor’s benefits exists, but it depends on specific conditions, which include:
- Economic Dependence: To qualify for survivor’s benefits, the ex-partner must prove financial dependence on the deceased insured individual, even after the relationship ended and regardless of whether the deceased remarried or entered into a new relationship.
- Receipt of Alimony: If the ex-partner was receiving alimony or financial support from the deceased insured individual, this dependency can serve as grounds to claim the benefit.
- Long-Term Relationship: The duration of the relationship can also be a relevant factor. A stable and long-term relationship may strengthen the right to survivor’s benefits.
- Ex-Partner as the Sole Dependent: If the ex-partner is the sole dependent of the deceased insured individual, they may qualify for the survivor’s benefits, even if the deceased had other relationships.
