The Federal Regional Court of the 1st Region (TRF1) has upheld the granting of retirement benefits based on length of contribution to a teacher, rejecting the appeal filed by the National Institute of Social Security (INSS).
The unanimous decision ensures the teacher's right to retirement and includes the payment of retroactive amounts with monetary adjustment.
The INSS appealed to the TRF1, arguing that "the teacher had not proven the required teaching time to qualify for retirement" and challenged the documentation submitted, requesting a review of the initial decision that granted the benefit.
According to the case's rapporteur, Federal Judge Morais da Rocha, "the teacher provided sufficient evidence to prove her length of service," and the documents demonstrated that she worked as a teacher for 25 years, 4 months, and 13 days.
Under Law No. 8,213/1991, teachers are entitled to retirement based on length of contribution with reduced requirements compared to other professions. Male teachers must prove 30 years of service, while female teachers are required to prove 25 years.
