The Labor Court has recognized the employment relationship of a business operator with Nu Financeira, classifying her as a banking sector employee and ensuring her entitlement to the rights granted to this category.
The company contested the claims, arguing that it is not a bank and asserting that the worker also provided services to other companies within the group.
However, the judge dismissed these arguments and concluded that, despite being formally distinct, the companies within the group operate as a single organization, Nubank.
The magistrate emphasized that the group's operations and structure are regarded by the financial market and the media as a banking institution. Consequently, the companies cannot benefit from this image in the marketplace while denying such a condition in labor relations.
As a result of the decision, the worker's employment relationship will be officially classified under the banking category, entitling her to receive benefits such as overtime pay, meal allowances, and food allowances.
